Terms and Conditions of Nimetsu

This document sets forth the general terms and conditions that govern access to, use of, and participation in the service known as Nimetsu. This service consists of an automated bot designed for the WhatsApp platform and its associated websites, including:

• https://grupos.nimetsu.com

Nimetsu is a personal project developed, maintained, and managed by Daniel Ignacio Báez Cofré, who acts as the sole person responsible for the system, without the backing of a registered legal entity. All rights to the code, structure, brand, content, and design belong to its author.

By accessing, interacting with, or using any of Nimetsu's features, the user voluntarily and fully accepts these Terms and Conditions. This acceptance includes future modifications that may be made without prior notice. Continued use of the service implies agreement with any updated version of these terms.

If the user does not agree with these Terms, they must refrain from using any functionality of the service.

Nimetsu is an interactive and automated bot that operates in authorized WhatsApp groups. It communicates using technologies such as Node.js, Baileys, and structured databases to provide a broad, social, and gamified experience.

Its main features include:

• Automatic group moderation (antilink, warns, antinsfw, filters, etc.)
• Reactions, gestures, and interaction commands between members
• Virtual economy system with coins called NimuCoins
• Games of chance: roulette, blackjack, coinflip, dice, group bets
• Gacha system: character collecting, trading, and selling
• Multimedia commands: sticker conversion, text-to-audio, memes
• Downloaders from external platforms (YouTube, TikTok, Facebook, etc.)
• NSFW menus for adults (requires manual activation)
• Group search and public group integration (grupos.nimetsu.com)
• Profiles, levels, achievements, and more

The service is in beta phase, so it may present occasional errors or frequent changes.

The user undertakes to use Nimetsu in accordance with applicable laws, respect for other participants, ethical principles, and good digital practices. Using this service implies a conscious commitment to act responsibly in all spaces where the bot is enabled.

Each user:

• Is fully responsible for their use of the service and for any consequences arising from it.
• Acknowledges that downloads, NSFW, economy, or interactions must be used with ethical judgment in accordance with these Terms.
• Declares that any content generated or requested is done of their own free will and at their own risk, releasing Nimetsu from legal, moral, or social consequences.
• Accepts that group administration (including enabling sensitive features) is the responsibility of the group’s administrators.
• Commits not to use the bot for illegal or abusive purposes or to harm third parties.
• Will report failures or misuse through the established channels.

Nimetsu reserves the right to monitor usage, limit commands, suspend groups, block users, or restrict access to features in response to conduct contrary to these Terms, without prior notice.

NSFW (Not Safe For Work) features are disabled by default and require explicit activation via the !nsfw on command, exclusively by a group administrator.

Activation implies that:

• All group participants declare they are over 18 years old.
• Use is voluntary and under individual responsibility.
• Erotic, suggestive, or double-entendre content may be shown (not illegal).

Administrator obligation: the administrator is responsible for the community and, if they are aware of the presence of minors, they must remove them from the group or disable NSFW features immediately.

Prohibited and sanctionable:

• Material involving minors, extreme violence, gore, or illegal fetish content.
• Spam with unsolicited sexual content.

Nimetsu may analyze images if filters are active, and block infringing users or groups.

For its operation, Nimetsu may store and process the following information:

a) Automatic data

• WhatsApp ID (@s.whatsapp.net or @lid)
• User’s display name
• Technical data on web portals (browser, IP, OS)
• Usage activity and executed commands

b) Optional data (provided by the user)

• Date of birth
• Gender
• Profile description
• Preferences and relationships within the bot

c) Temporary data

• Limited history of AI messages (if enabled)
• Images/files sent for conversion (deleted after use)

Nimetsu may interact with external APIs (e.g., content moderation, text or image generation). Efforts are made to ensure these providers meet security standards, but no liability is assumed for third-party failures.

• Data is not sold or shared with third parties.
• It is used exclusively for the bot’s internal functions.
• The user may request data deletion via the official contact.

• Using the service for illegal, violent, or criminal purposes.
• Distributing copyrighted content without authorization.
• Using spam, external bots, or malicious automation.
• Creating fake accounts or cloning groups for abuse.
• Impersonating others or using the name “Nimetsu” without permission.
• Selling access to the service without the developer’s authorization.

Sanctions: permanent ban, reports in serious cases, and cancellation of premium access when applicable.

a) Free mode

Nimetsu is offered free of charge with no guarantee of continuity or preferential support. Limits or changes may apply without notice.

b) Paid services (premium)

Some features, stability, customization, or integrations may require optional payments (priority access, dedicated servers, etc.). Payment does not guarantee uninterrupted operation and is non-refundable except in the event of an error attributable to Nimetsu.

c) Failures and limitations

• There may be interruptions, errors, or malfunctions.
• Permanent uptime is not guaranteed.
• Compatibility may be affected by WhatsApp changes.

d) Modifications

The service may be modified, suspended, or terminated in whole or in part at any time and without notice.

The service is provided “as is”, without warranties of performance, accuracy, availability, or security beyond what is reasonable for an experimental tool.

The developer is not liable for indirect damages, data loss, interruptions, or technical incompatibilities with WhatsApp or other services.

The design, command architecture, source code, web interface, trade name, logos, and any component of Nimetsu and Nimetsu Grupos are the property of Daniel Ignacio Báez Cofré, unless otherwise stated.

Prohibited: total/partial reproduction, reverse engineering, modification, redistribution, or derivative services without authorization; unauthorized use of the name “Nimetsu”.

Infringements may lead to legal action and immediate cancellation of access and services.

Nimetsu is an independent service and is not affiliated with, associated with, endorsed by, or sponsored by WhatsApp Inc. or Meta Platforms, Inc.

The term “WhatsApp” is used for descriptive purposes. WhatsApp and Meta are registered trademarks of their respective owners.

This document is governed by the laws of the Republic of Chile. For disputes, the parties submit to the ordinary courts of Santiago, waiving any other jurisdiction.
